I'm pretty sure Ginkaku feels the will of the kyuubi. It's the kyuubi's chakra after all. I doubt you can just steal something as "alive" as the 9tails chakra.

^ I wouldn't doubt it, besides the anger he has because he lost his brother there seems to be some Kyuubi malice in his words as well.

We have to remember. The Bijuu are living embodiments of chakra. Created through Izanagi. Form given to imagination and life given to form. In other words. the Kyubi's chakra as a whole is alive through it's sheer malice. Kyubi is chakra so any part of itself that exists will be influenced by his will through the emotions of whoever possesses it. Frankly i think the number of tails formed does not reflect how much of kyubi's chakra he has but rather how much kyubi's influence has hold. The chakra level itself might be quite weak and just has the form of 6 tails in relation to his anger.
