So we are kept left out on what Itachi had to say because of naruto..
And then we get some more sasuke fightning. And there is someone behind Itachi.. I wonder who..

It would make more sence if it was Sasuke, since Itachi wants to talk with Sasuke behind closed doors..
To me it looks like sasuke, you can clearly see a brick wall behind sasuke and the shadow..Thats was I base my point on..

EDIT: OR...It could be Tobi, the shadow look like it got his hut on...

Can't be unless you take that Itachi "appeared" facing the oposite of sasuke.. then did a turn, because we see his eye opening, so he is facing us and there is the shadow behind..
Maybe I'm seeing too much, might be as well just his shadow.. although its too dark for that, and there is cleary no direct light source between them to create such defined shadow.
And samehada usualy lays on a angle.. so the head would look distorced not overlap, thats what I think at least

I think you're right..it gotta be another person who's behind Itachi..I just thought it would be more "dramatic" if sasuke stood behindf and Itachi confronted him..I guess thats just me...But then who is the other guy? Its most certainly not Kisame..theres no reason why he would be in the shadows...The only person I can think of is Tobi, the 3 sharingan's finally assembled..

"Itachi" Sasuke encountered might be Kabuto, you know. After all, with his knowledge on human body and Orochimaru's powers, he could easily impersonate anyone in his quest of killing Sasuke. I think that the final fight between Itachi and Sasuke will happen much later.
