    Default 23 000 defendants in bit torrent case

    At least 23,000 file sharers soon will likely get notified they are being sued for downloading the Expendables in what has become the single largest illegal-BitTorrent-downloading case in U.S. history.

    A federal judge in the case has agreed to allow the U.S. Copyright Group to subpoena internet service providers to find out the identity of everybody who had illegally downloaded the 2010 Sylvester Stallone flick meaning the number of defendants is likely to dramatically increase as new purloiners are discovered. Once an ISP gets the subpoena, it usually notifies the account holder that his or her subscriber information is being turned over to the Copyright Group, which last year pioneered the practice of suing BitTorrent downloaders in the United States.

    Subpoenas are expected to go out this week.
    First Pirate Bay, now the actual users? Hmmm.

    I dunno how the law works in the US, but how exactly do they prove that a specific user is to blame? If I say that I didn't bother to secure my home network, what can they do about it?

    Internet subscriptions are governed by contract, so you would still be contractually liable for all activity that happens on your connection.

    I think it would be up to the court to decide whether to prosecute you for illegal downloading or (assuming you could identify the culprit) prosecute the downloader for breach of copyright, although technically torrenting in itself is not a crime (but you might still also be liable for breach of copyright).

    Must be a real kick in the teeth to those who get subpoenaed. You have to sit through a really shit movie and then you get sued for it.

    I suppose it could be worse. I'd rather not be one of those people that have to explain to friends and family that they're being sued over an illegal download of 'Nude Nuns with Guns'.

    I never torrent movie - usually only go to the local cinema with my friends when I feel like it.

    I have a habit where I actually buy movies and then can never be bothered to watch them. I still haven't watched I Am Legend.

    Eh, it was a passable action movie, hope I dont get sued for millions, student loans are a bitch already.

    Really? I was picking it to pieces. Now the A-team, that was a good movie, I could still find issues with it but it was certainly much better than the expendables.
