Technically they didn't flee, according to the anime they were taken while still unconscious in there new hollow state by Urahara. I don't recall anyone calling them criminals though so isn't your link to Isshin calling them criminals mispoken. Yes they were to be destroyed but that isn't enough, in the vet world if a dog develops rabies he isn't a criminal until he does something. Whether the dog has done something it is still customary to have the animal destroyed. If anyone was considered a criminal by SS it would be the ex-shinigami Urahara who was supposed to be banished to earth for a 100 years with his powers stripped of him, per the order of Central Room 46.

Interesting in the manga it says Urahara would be eternally banished to earth, and that the experiments would be dealt with as hollows. How do you figure Urahara would get a lighter sentence when he is the one that kidnapped them and took them to earth, they were only failed experiments in the councils eyes.
Terasiel, I don't think anyone is disagreeing with the fact Urahara keeps in contact with them.

If it happened in the Anime and not in the Manga then it doesn't mean shit. Sorry but it's true.
My link was to show that Urahara (and Isshin) did not know where the Visored were and that they did not keep in contact with each other. And if you want to get technical, Soul Society is the law of the spiritual world, they ordered to have Shinji and the others dealt with as hollow. Since the Visored fled from the law by hiding in the human world in their gigais, that made them criminals. I know I worded it strangely but when I put 'wanted criminals' I meant as they are now.
Well since we can't see them breathing in the manga you can come to your own conclusions during that specific part.

So are you now going to assume that they were told they would be killed on site if they entered Soul Society, or did Urahara not tell them all the facts which he has a history of doing. Please remind me were they conscious when Central Room 46 said they were to be dealt with as hollows?
Are the vaizards in ther gigas? because, you know, they can use their powers and all, and I thought you had to get out of your gigai to use them. Which bring my next question there are like 4 vaizard captains in their own bodies and they do not need the limit to avoid a rupture in space or whatever?

That one I think is actually very easy to answer: The limiter was said to be used as a way of preventing cross-dimensional manifestation from causing a disruption between said dimensions.
The only time that would have mattered was otherwise suppressed by the gigai and the presumably unconscious states of the four captains as they were being "smuggled."
