Plus when he trained to regain his shinigami powers before the SS arc, they broke his soul chain to do it. Normally that means he already died, right. Because it was said in the beginning when Orohime's brother came back as a hollow that you die when your soul chain is severed (i think).
Which would mean he is a real shinigami and his body is a gigai. But I think Kubo forgot about that little detail.
^ Tite kube seems to forget alot of "little" details in his own manga. This whole hollow shinigami thing can b so deep and complex sometimes

Ichigo already became an exception in the world that Bleach takes palce in because he didnīt became a Death God when Urahara was destroy his chain link, he became a Vizard right away. And Shirosaki was already saving him several times during soul society.
